NonCompeteState exists for a single audience: workers facing or considering a non-compete agreement, often during the high-anxiety moment of a job change or exit negotiation. The audience deserves better than “it depends on your state” and better than an AI-generated summary of an FTC rule that no longer exists.

Why this site

The federal landscape changed twice between 2024 and 2026. The FTC's 2024 final rule banning most non-competes was struck down by the Northern District of Texas in Ryan v. FTC(Aug 2024). The FTC abandoned its appeal in September 2025 and formally removed the rule from federal regulations in February 2026. The field is back to a 50-state patchwork — and the patchwork itself moves fast, with new state bills and amendments every legislative session (tracked in resources like Epstein Becker Green's 50-State Noncompete Survey).

Generic explainers can't keep up. Most either still anchor on the FTC rule's proposed text or stop at “depends on your state.” Neither is useful when you're actually trying to decide whether to take a competing job offer or negotiate an exit. NonCompeteState applies the actual six-input test for your situation.

Editorial integrity

Three commitments govern every page:

  1. No fabrication. Every statute citation, every case-law anchor, every threshold value is either (a) primary-source verified with a verification date, (b) widely confirmed via secondary law-firm analyses with that flag visible, or (c) explicitly marked as an estimate or placeholder. We never invent.

  2. Indeterminate is honest.When the law genuinely doesn't resolve a situation, the decoder returns “indeterminate — consult an attorney” rather than guess. Pretending to know is worse than admitting we don't.

  3. Attorney review is non-optional. Real reviewer attribution, real bar number, real state of admission, real LinkedIn — never a generic stock photo or made-up credential. Until that signoff is on the page, the “research tier” chip stays visible.
